3. Products & Orders
We make every effort to accurately represent our plants and products. However, because plants are living organisms, natural variation in size, shape, color, and leaf count from listing photos is expected and is not grounds for a return or claim.
Prices are subject to change without notice. Always review your order total before completing checkout. We reserve the right to cancel any order at our discretion and will notify you promptly if cancellation occurs, with a full refund issued to your original payment method.
Product availability is not guaranteed. In the event a plant you ordered is out of stock after purchase, we will contact you to arrange a suitable alternative or issue a full refund.
4. Payments
Full payment is required at the time of checkout. We accept all major credit and debit cards and other payment methods available at checkout. By submitting payment, you represent that you are authorized to use the payment method provided.
All transactions are processed securely. We do not store full payment card details on our servers.
5. Shipping
All orders are subject to our Shipping Policy, which governs processing times, carriers, delivery windows, and cold-weather shipping requirements. By placing an order, you agree to the terms outlined in our Shipping Policy.
It is the customer's responsibility to provide an accurate and complete shipping address at checkout. Address changes can only be accommodated within 24–48 hours of order placement. We are not responsible for delays or non-delivery resulting from an incorrectly entered address.
6. Cold Weather & Heat Packs
Tropical and subtropical plants are sensitive to cold temperatures. It is the customer's responsibility to add a heat pack to their order at checkout when shipping to cold-weather regions. Izzy's Tropicals and Plant Shop is not responsible for cold-related transit damage on orders where a heat pack was not purchased. Orders that decline a heat pack and experience cold damage are not eligible for our Arrive-Alive Guarantee, store credit, or replacement.
7. Live Plant Guarantee & Returns
All live plant sales are final. We do not accept returns or exchanges on live plants once they have shipped.
We offer a 30-Day Arrive-Alive Guarantee covering severe shipping damage — including plants that arrive crushed, broken, or dead due to transit conditions. This guarantee covers shipping damage only and does not cover decline due to care conditions after delivery.

8. Limitation of Liability
To the fullest extent permitted by applicable law, Izzy's Tropicals and Plant Shop's liability to you for any claim arising from your use of our website or purchase of our products is limited to the purchase price of the item(s) in question. We are not liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of our website or products.
Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.
9. Privacy
Your use of our website is also governed by our [Privacy Policy], which is incorporated into these Terms by reference. These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Dilley, Texas.

If we are unable to resolve the dispute informally within 30 days, either party may pursue resolution through binding arbitration or small claims court, as permitted by applicable law.
